Legal notice and terms of use

These are the terms of access and use of the website bonfireofwishes.solucionec.com and of the mobile app Bonfire of Wishes, for the purposes of Spanish Act 34/2002 on information society services and electronic commerce (LSSI).

1. What the service is

Bonfire of Wishes is an entertainment app. The user writes a wish on a sheet of paper on screen, sends it, and the app burns it in a bonfire animation. The app keeps a list of the wishes sent from that device so the user can read them back.

Writing a wish is a ritual, not a method. SOLUCIONEC makes no claim, express or implied, that a wish sent through the app will come true, and the service does not constitute advice of any kind — spiritual, psychological, medical, financial or otherwise.

The app also offers to add a wish to a real bonfire at the next lighting. That option is voluntary, free of charge, offered inside the app before anything happens, and it is a symbolic gesture: SOLUCIONEC does not guarantee any date, any particular fire, any proof of burning or any individual notice that a given wish was included.

The service is aimed at people aged 18 or over. By using it, the user declares that they are at least that age.

The app is free and supported by advertising. It requires no registration and no account, and it contains no in-app purchases.

2. Terms of access and use

Accessing and using the website and the app implies full acceptance of these terms and of the other published policies (privacy policy and cookie policy).

SOLUCIONEC may change the presentation, the configuration and the contents of the service at any time, as well as these terms.

2.1 What the user sends

The text of a wish is written and sent by the user, who is solely responsible for it. Before sending anything, please note:

• Write the wish, not your personal details. Do not include your name, address, telephone number, ID number, bank details or any other information that identifies you or someone else.
• Do not include information about third parties, and in particular nothing that reveals their health, beliefs, sexual orientation, political opinions or any other especially protected category.
• Do not send unlawful, threatening, defamatory, discriminatory or pornographic content, content that infringes third-party rights, or content involving minors.

SOLUCIONEC does not publish the wishes and does not review them one by one. It may, however, delete any content that breaches this clause, that is reported to it, or that a competent authority requires it to remove, and it may exclude such content from a real bonfire without notice. By sending a wish, the user grants SOLUCIONEC the strictly necessary permission to store it, to show it back to that same device and, where the user asks for it, to print it in order to burn it.

2.2 Prohibited uses

The user undertakes to use the service in accordance with the law, with these terms and in good faith. The following is expressly prohibited:

• Presenting the service as an oracle, a divination service, a therapy or a religious service, or presenting its results as verified facts.
• Using the service to harass, ridicule, coerce or otherwise harm third parties.
• Sending mass or automated submissions, or attempting to read, alter or delete wishes sent from other devices.
• Introducing viruses or malicious code, or attempting to reach restricted areas or SOLUCIONEC's systems by illegitimate means.
• Reproducing, copying, distributing or publicly communicating the contents of the service without authorisation from their owner.

2.3 Intellectual and industrial property

Access to the service transfers no rights over the trade marks, trade names, logos, texts, images, animations, software or any other protected content, which belong to SOLUCIONEC or to their legitimate owners. Modifying, copying, reusing, exploiting, reproducing or publicly communicating them without express written authorisation is prohibited. The text of a wish remains the user's.

2.4 Availability and disclaimer

SOLUCIONEC does not guarantee permanent availability or continuity of the service, which depends on third-party hosting providers, on the app stores and on the user's own connection. Sending a wish requires an internet connection and the app will report a failure rather than silently discarding the text.

Liability is excluded for damage arising from interruption of the service, from harmful elements transmitted by third parties, from decisions the user takes on the basis of the ritual, and from the loss of data stored on the user's own devices. Nothing in these terms limits or excludes liability that cannot be excluded under applicable law, in particular towards consumers.

3. Advertising

The app shows advertising served by Google AdMob, including banner, interstitial and rewarded video formats. Before personalised ads are shown, the user's consent is requested through Google's User Messaging Platform (UMP) and, on iOS, through the system tracking permission (ATT). The user can review or withdraw that choice at any time from within the app. Details are in the privacy policy.

The rewarded video format is always optional: the app explains what it offers, the user accepts or declines, and declining never prevents a wish from being sent or burned in the app.

4. Third-party links

The website and the app may include links to third-party pages — the app stores, Solucionec's own site and social networks. SOLUCIONEC does not control those sites and is not responsible for their contents, their availability or their privacy policies.

5. Data protection

The processing of personal data is described in the privacy policy, and the use of cookies and similar technologies in the cookie policy.

6. Applicable law and jurisdiction

These terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts that are competent under the law, respecting in all cases the jurisdiction that the law grants to the user when acting as a consumer.
